1. General Conditions

YourFaceInTheGame.com (”Site”, “YourFaceInTheGame”), is a service of Propelling Solutions LLC that allows you to put a person’s face into a web-based video game.

Games are created through the “Game Creator”, which is located at YourFaceInTheGame.com, but can also be displayed on any web site on the internet. The software used to display and play a game is also the same software that is used for the game creator, and herein will be referred to as the “Game Container”. At the bottom of the Game Container is a set of buttons and features, which will be referred to as the “Action Bar”.

By accessing YourFaceInTheGame, or our Game Container, you are agreeing to be bound by these
web site Terms of Service (”Terms”), all applicable laws and regulations,
and agree that you are responsible for compliance with any applicable local
laws. If you do not agree with any of these terms, you are prohibited from
using or accessing this site. The materials contained in this web site are
protected by applicable copyright and trade mark law.

You must be 13 years or older to use this site.

2. Creating a game

By creating a game, you agree to the following:

  • You are the copyright owner of the image you have uploaded. If you are not the copyright owner, you have obtained written permission from the copyright owner.
  • The photo being uploaded is a photo of you. If the photo you have uploaded is not a photo of you, you have obtained written permission from the person whose photo you have uploaded.
  • You grant us permission to use your photo without limitations. Some examples in which we may use the photo include, but are not limited to:
    • Promotional materials
    • Multiplayer games
    • Advertisements

3. Sending a game

The Action Bar has a “send to a friend” option, which allows you to send the game to a friend. By using this feature, you agree to the following:

  • You have obtained permission from friends to which you are sending a game.
  • You will not use this feature to spam or otherwise send games to people you do not know.

4. Embedding a game

YourFaceInTheGame wants you to share the games you create with your friends. By using the “link to or embed this game” option in the Action Bar, you agree to the following:

  • You will use our embed code. The only part of the embed code you can modify is the alternative content, however, you must include a hyperlink to our site in your alternative content. If you do not do this, you will be asked to remove our game creator from your site.
  • You will not modify, decompile, or change the Game Container in any way.

5.  Using the “Tweet this!” feature

The YourFaceInTheGame Game Container allows users to update their twitter (www.twitter.com) status directly from the application.  Your twitter login information IS NOT STORED OR SAVED at any time.  We respect your privacy and ours as well - we use this feature too.  For more information about our privacy policy, please visit our privacy policy page.

Use the Twitter update feature at your own risk. Although we do not store your login information at anytime, we cannot guarantee the 100% safety of your twitter information.

6. Disclaimer

The materials on YourFaceInTheGame’s web site are provided “as is”. YourFaceInTheGame makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, YourFaceInTheGame does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

7. Limitations

In no event shall YourFaceInTheGame or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on YourFaceInTheGame’s Internet site, even if YourFaceInTheGame or a YourFaceInTheGame authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

8. Revisions and Errors

The materials appearing on YourFaceInTheGame’s web site could include technical, typographical, or photographic errors. YourFaceInTheGame does not warrant that any of the materials on its web site are accurate, complete, or current. YourFaceInTheGame may make changes to the materials contained on its web site at any time without notice. YourFaceInTheGame does not, however, make any commitment to update the materials.

YourFaceInTheGame may revise these Terms of Service for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms of Service.

10. Governing Law

Any claim relating to YourFaceInTheGame’s web site shall be governed by the laws of the State of Massachusetts without regard to its conflict of law provisions.
